Terms and Conditions
These terms describe your rights and responsibilities when using Katiba, including app content, support, acceptable use, disclaimers, and limitations.
Last updated: May 25, 2026
1. Agreement to these terms
These Terms and Conditions govern your use of the Katiba mobile application, the public pages at katiba.app, and related support services. By downloading, accessing, or using Katiba, you agree to these terms. If you do not agree, do not use the app.
If you downloaded Katiba from Apple's App Store, these terms supplement Apple's applicable terms, including the Apple Media Services Terms and Apple's standard app license terms, unless a different license is presented in the App Store.
2. What Katiba provides
Katiba provides access to constitutional and civic information, including reading, searching, bookmarks, annotations, summaries, references, support pages, and related educational features. You may use Katiba for personal, educational, civic, journalistic, professional, and research purposes, subject to these terms and applicable law.
3. No legal advice
Katiba is an informational tool. It does not provide legal advice, does not create a lawyer-client relationship, and should not be used as a substitute for advice from a qualified legal professional. You are responsible for seeking professional advice before making decisions about legal rights, obligations, deadlines, disputes, court proceedings, government processes, or other legal matters.
4. Content accuracy and official sources
We work to keep Katiba useful and accurate, but constitutional text, annotations, summaries, translations, citations, references, and other content may contain errors, omissions, formatting issues, outdated information, or interpretation differences. You are responsible for verifying important information against official sources before relying on it.
If you find an error, please report it through the app or by emailing support@katiba.app. We may review and update content at our discretion.
5. Accounts and offline features
Katiba's public reading features are intended to work without a user account. Some current or future features may store data locally on your device or require network access, permissions, or an account. You are responsible for maintaining your device, backups, software updates, and access controls.
6. Acceptable use
You agree that you will not:
- Use Katiba in a way that violates applicable law or another person's rights.
- Attempt to gain unauthorized access to any system, account, API, or service.
- Interfere with, disrupt, overload, scrape, reverse engineer, or misuse the app.
- Upload or send malware, spam, abusive messages, or unlawful material through support channels.
- Remove copyright, license, attribution, or other notices from app content.
- Misrepresent Katiba content as official legal advice or an official government service.
7. Intellectual property and content rights
Katiba's app design, software, branding, layout, annotations, summaries, editorial materials, and original content are protected by intellectual property laws. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the app for lawful personal and educational purposes.
Public legal materials may be subject to separate public-sector, copyright, or reuse rules. Nothing in these terms limits rights you may have under applicable law to access or use public legal materials.
8. Feedback and submissions
If you send suggestions, corrections, reports, or other feedback, you give us permission to use, reproduce, modify, and incorporate that feedback into Katiba without compensation or obligation to you. Do not send confidential information through support unless we have separately agreed to receive it.
9. Third-party services
Katiba may be distributed through app stores and may rely on third-party services for hosting, email, diagnostics, analytics, crash reporting, or support. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services that we do not control.
10. Privacy
Our Privacy Policy explains how information is handled when you use Katiba and related support pages. By using Katiba, you acknowledge that information will be processed as described in the Privacy Policy.
11. Changes, suspension, and availability
Katiba may change, add, or remove features, content, platforms, or support channels over time. We may suspend, limit, or discontinue parts of the app when needed for maintenance, security, legal compliance, product changes, abuse prevention, or operational reasons.
We do not guarantee that Katiba will always be available, uninterrupted, secure, current, or error-free.
12. Disclaimers
To the fullest extent permitted by law, Katiba is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee any legal outcome, government response, court result, civic action, interpretation, or consequence from using Katiba.
13. Limitation of liability
To the fullest extent permitted by law, Katiba and its operators, contributors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, legal consequences, service interruption, or reliance on app content.
Where liability cannot be excluded under applicable law, liability will be limited to the maximum extent permitted by law.
14. Indemnity
You agree to defend, indemnify, and hold harmless Katiba and its operators, contributors, service providers, and affiliates from claims, damages, liabilities, losses, and expenses arising from your misuse of the app, violation of these terms, violation of law, or infringement of another person's rights.
15. Termination
You may stop using Katiba at any time. We may suspend or terminate access to any networked feature or support channel if we reasonably believe you have violated these terms, created risk, or used the app unlawfully or abusively.
16. Governing law
These terms are governed by the laws of Kenya, except for conflict-of-law rules. Courts with appropriate jurisdiction in Kenya will handle disputes that cannot be resolved informally, unless applicable consumer protection law requires another forum.
17. Changes to these terms
We may update these terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Your continued use of Katiba after changes become effective means you accept the updated terms.
